Definitions

• "User" / "You" – Any individual or entity accessing or using the Platform, including job seekers and employers.
• "Job Seeker" – A user creating a profile, uploading CVs, or applying for jobs.
• "Employer" – A business or individual posting job vacancies or accessing candidate profiles.
• "Content" – Any text, images, files, CVs, data, or materials submitted or uploaded to the Platform.

Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you confirm that you meet this requirement.

User Accounts

3.1 Registration

Users must create an account to access certain features. You agree to:

• Provide accurate, truthful, and complete information.
• Keep your login credentials confidential.
• Take full responsibility for all actions performed under your account.

3.2 Account Security

SKILLPOTS is not liable for unauthorised access caused by your failure to secure your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion for violations of these Terms or misuse of the Platform.

User Responsibilities

4.1 Accuracy of Information

Users are responsible for ensuring that all information provided—including CVs, qualifications, and job postings—is accurate and not misleading.

4.2 Prohibited Activities

Users must not:

• Upload false, fraudulent, or misleading information.
• Post offensive, discriminatory, or illegal content.
• Attempt to access accounts or data belonging to others.
• Use the Platform for unlawful purposes.

Job Seekers

5.1 Profile & CV Upload

• You grant SKILLPOTS a non-exclusive, royalty-free licence to store, display, and share your information with prospective employers.
• You confirm that you own or have rights to share all content uploaded.

5.2 Job Applications

SKILLPOTS only provides a connection platform. We do not:

• Guarantee employment or employer responses.
• Verify employer authenticity (although we conduct reasonable checks).

Employers

6.1 Job Posting

Employers must ensure that job advertisements:

• Are lawful, accurate, and non-deceptive.
• Do not discriminate based on gender, race, religion, disability, or any prohibited grounds under Sri Lankan law.

6.2 Use of Candidate Information

• Use candidate data solely for recruitment purposes.
• Not share candidate information with third parties without consent.

Platform Responsibilities & Limitations

• No Guarantee of Accuracy: SKILLPOTS does not verify all info and is not responsible for accuracy or user conduct.
• No Employment Agency Services: SKILLPOTS is a digital platform for advertising and connecting, not an agency.
• Service Availability: We strive for uninterrupted service but do not guarantee it.

Content Ownership & Intellectual Property

All content provided by users remains their property. By using the Platform, you grant us permission to use and display it for service functionality.

All SKILLPOTS trademarks, logos, and software remain the exclusive property of SKILLPOTS Lanka (Pvt) Ltd.

Data Privacy & Protection (PDPA)

SKILLPOTS Lanka (Pvt) Ltd is committed to safeguarding your personal data in accordance with the Personal Data Protection Act, No. 9 of 2022 (Sri Lanka) ("PDPA").

9.1 Compliance with Sri Lankan Law

Data is processed strictly in compliance with PDPA principles:

• Lawful and transparent processing
• Purpose limitation & Data minimisation
• Accuracy & Storage limitation
• Integrity and confidentiality

9.2 Purpose of Data Collection

We collect information for:

• Managing accounts & Matching job seekers
• Improving platform functionality & security

9.3 Data Sharing

Your data is shared with employers only when you apply or make your profile visible. We do not sell, rent, or trade your personal data.

9.4 Data Security

We implement technical and organisational measures to protect data. However, use is at your own risk.

9.5 User Rights under PDPA

You have the right to:

• Request access or correction to personal data.
• Request deletion (subject to legal limitations).
• Withdraw consent for processing.

Payments & Subscription

• Users agree to pay applicable subscription or service fees.
• All payments are non-refundable unless stated otherwise.
• SKILLPOTS reserves the right to modify pricing with notice.

Limitation of Liability

To the maximum extent permitted by Sri Lankan law, SKILLPOTS is not liable for:

• Loss of job opportunities or employer actions.
• Inaccurate user information or technical issues.

Indemnification

You agree to indemnify SKILLPOTS from claims arising from your misuse of the Platform, breach of Terms, or violation of laws.

Suspension / Termination of Service

SKILLPOTS may suspend or terminate access without notice if you violate these Terms or harm the Platform.

Changes to Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of Sri Lankan courts.
